Mpofu and Chimombe seek delay in pre-sentencing hearing as defence demands written judgment

HARARE businessmen, Moses Mpofu and Mike Chimombe, who were convicted of fraud, are currently at the High Court for their pre-sentencing hearing, in accordance with the new sentencing guidelines.

However, the defence made an application to stay the pre-sentencing hearing, requesting a written judgment of the conviction from Justice Pisirayi Kwenda.

The defence is arguing that the written judgment is critical in their preparation of submissions and arguments for the pre-sentencing hearing.

The State opposed the application, arguing that having the written judgment was immaterial to the pre-sentencing hearing.

Justice Kwenda is expected to deliver a ruling on the application this afternoon.

Mpofu and Chimombe were found guilty of defrauding the government of US$7 million after misrepresentation of facts that led them to win a tender to supply goats for the Presidential Goat Pass-on Scheme.
