Supreme Court reserves judgement on Chivayo case

Story by Peter Chivhima

THE Supreme Court has reserved judgement in a case in which the Zimbabwe Power Company (ZPC) appealed against a High Court ruling, which found Harare Businessman Wicknell Chivayo not guilty of contravening contractual agreements with the company.

This comes after Chivayo’s Company Intratek Zimbabwe was granted a contract to implement a solar project in Gwanda.

ZPC is appealing against a High Court ruling which found Chivayo not guilty of contravening contractual agreements and gave him the green light to go ahead with the Gwanda Solar project.

The Power Company claims that Chivayo through Intratek failed to meet the prescribed conditions of the contract.

The agreement between the two parties was signed after a successful tender bid, for the engineering, procurement and construction of a 1 000MW Gwanda Solar Power Station in 2015.

ZPC later sued Chivayo for fraud, but he was cleared by the courts before he was given the green light to implement the project.
