THE High Court has thrown out Harare businessmen Mike Chimombe and Moses Mpofu’s request to have their matter referred to the Constitutional Court.
The duo is facing charges of fraud involving more than US$7 million in a goat supply tender scam.
Chimombe and Mpofu’s bid to have their matter referred to the Constitutional Court flopped after High Court Judge Justice Pisirayi Kwenda ruled against them.
In his ruling, Justice Kwenda dismissed all 17 issues raised by the duo who claimed their constitutional rights were being infringed upon.
He said Chimombe and Mpofu should have raised their Constitutional concerns with the Magistrates Court highlighting that their request is frivolous and has no merit.
The duo allegedly forged documents for their company Black Deck Private Limited to secure a tender issued by the Ministry of Lands, Agriculture, Fisheries, Water and Rural Development.
They are expected back in court on the 10th of February next year for continuation of trial.
