Constitutional Court dismisses challenges to Constitutional Amendment No. 3 Bill

THE Constitutional Court has dismissed two separate applications challenging the legality of the Constitutional Amendment No. 3 Bill (CAB3), clearing the way for Parliament to continue debating the proposed legislation.

The first application, filed by six war veterans and represented by Professor Lovemore Madhuku, was struck off the roll after the court ruled that the matter had been improperly brought before it.

In a separate case, an application by former Binga North legislator Prince Dubeko Sibanda was dismissed on the grounds that it was not yet ripe for determination.

The rulings come as Parliament continues deliberations on the Constitutional Amendment No. 3 Bill, which has generated extensive debate among legislators.

Among its key proposals, the Bill seeks to extend the electoral cycle from five years to seven years and introduce a parliamentary process for the election of the President.

The proposed legislation also provides for the establishment of a Zimbabwe Electoral Delimitation Commission and seeks to transfer responsibility for administering the voters’ roll from the Zimbabwe Electoral Commission (ZEC) to the Registrar General’s Office.

With the legal challenges dismissed, debate on the Bill is expected to continue in Parliament as lawmakers consider its various provisions before the legislative process proceeds to the next stage.
