THE High Court of Zimbabwe has dismissed with costs an application challenging the legality of the Land Tenure Programme that was introduced by President Emmerson Mnangagwa last year.
Six applicants, represented by Tendai Biti Law Chambers, were arguing that the policy was unconstitutional and violated the provisions of sections 72, 293 and 297 of the Constitution.
They also argued that every land tenure ought to be approved by the Zimbabwe Land Commission and that agricultural land cannot be disposed of without an Act of Parliament.
However, respondents to the matter argued that the applicants were labouring under a wrong assumption that the Act of Parliament was not in place.
On whether or not the land tenure ought to be approved by the Zimbabwe Land Commission, the respondents alleged that the executive is not bound by the recommendations of the Zimbabwe Land Commission.
After hearing submissions of both the applicants and respondents, the High Court dismissed the application with costs for lack of merit.
The verdict was handed down on November 18 in Harare.
