MDC Vice Chairperson, Job Sikhala acquitted

MDC NATIONAL Vice Chairperson, Job Sikhala who was facing charges of attempting to subvert a constitutionally elected government has been acquitted of the criminal charges.
In handing down his judgment, Masvingo high court judge, Justice Garainesu Mawadze said the court cannot put Sikhala on trial based on semantics.
He also said Sikhala did not contravene section 22 of the constitution as the state had built a case against him basing on statements taken out of context.
Justice Mawadze proved to the court that the state had failed to understand the difference between overthrowing a president as an individual and government.
In his defence outline and before the acquittal, Sikhala’s defense counsel led by Beatrice Mtetwa argued that their client could have been referring to the removal of the president through a legal process like impeachment and not necessarily overthrowing through violence means.
Sikhala was acquitted on technicality after Beatrice Mtetwa had made an application for exception on the subversion charges.
The MDC National Vice Chairperson made the alleged utterances at a rally in Bikita East at Mandadzaka grounds on 6 July last year.
