Constitutional law expert, Professor Lovemore Madhuku says he is of the view that only a competent court can decide on the legality of the process and the outcome of the MDC-T Extra Ordinary Congress held at the weekend.
Speaking to ZBC News, he said that having considered all the circumstances surrounding the congress, Senator Douglas Mwonzora is the President of the MDC-T until a court ruling finds otherwise.
“The legality of the election can now be decided by a court of law, otherwise Senator Mwonzora is the elected President until the court rules otherwise. Once the election process started, Dr Khupe no longer had the power to cancel the congress or to suspend another contestant,” said Professor Madhuku.
The election to choose the late Dr Morgan Richard Tsvangirai’s successor, saw Senator Douglas Mwonzora being declared the winner, amid allegations of fraud by other candidates, including the Acting party president Dr Thokozani Khupe, Morgen Komichi and Elias Mudzuri.
