Marry Mubaiwa approaches High Court for bail

MARRY Mubaiwa, the estranged wife of Vice President Retired General Constantino Chiwenga, who has been detained on charges of assault after she allegedly assaulted the family housemaid at Hellenic School in Borrowdale last week following an altercation over custody of children, has approached the High Court for bail after her attempt at the Harare Magistrate court hit a snag at the weekend.
Marry Mubaiwa who was remanded in custody last Saturday after being denied bail by Harare magistrate, Bianca Makwande on the basis that she had committed an offence while on bail of another violence-related crime, has since approached the High Court this Tuesday.
Appearing at the High Court this Monday, Mubaiwa admitted to confronting Delight Munyoro, a maid taking care of her children, saying she was influencing her three minor children not to talk to her other children from her previous marriage.
However, in her application, Mubaiwa argued that it is impossible for her to have slapped the complainant considering that her hands and arms are swollen and painful.
She begged the court to release her on her current bail conditions since she has complied from day one.
Mubaiwa had won her High Court appeal for custody of her three minor children and access to the matrimonial home.
But her joy was short-lived after VP Chiwenga filed a notice of appeal at the Supreme Court, challenging the lower court’s decision.
The filing of a notice of appeal effectively suspends the court ruling until the determination of the appeal.
Justice Christopher Dube-Banda ordered that the custody of children be restored to Mubaiwa and barred the Vice President from interfering with her access to the Borrowdale Brooke house.
Mubaiwa had sought the intervention of the High Court after she was barred from the matrimonial home and custody of the children taken from her following the couple’s fallout.
