The Constitutional court will this Friday continue its probe into the validity of a ruling that the Chief Justice cannot continue in office after the legal retirement age of 70.
The Constitutional court will this Friday conduct the hearing of a case where a private citizen is challenging a High court order nullifying Chief Justice Luke Malaba’s incumbency beyond the retirement age of 70.
The full bench of Con-court judges excluding the chief justice who is the subject in the case will seat for the hearing after the dismissal of an application to recuse all Supreme and Con-court judges.
The judges had earlier been cited as compromised in a High court case by NGO Forum executive director Musa Kika.
